Representative Cases
- Over the years, presided over pretrial and jury trial proceedings in dozens of landlord-tenant lawsuits, including claims by landlord for eviction, and claims by tenants for wrongful eviction or constructive eviction.
- Presided over jury trial by subtenant against landlord for constructive eviction. Subtenant was not paying her rent and was causing disturbance with the primary tenant. Subtenant claimed that landlord was spying on her, including use of cameras.
- Presided over pretrial and court trial proceedings in dozens of unlawful detainer actions by local government seeking to evict boat owners from a municipal marina; and in dozens of related individual actions by boat owners alleging claims for inverse condemnation against the local government entity.
- Served as Discovery Referee in landlord-tenant dispute for adjudication of over one dozen motions to compel and other pretrial discovery motions. Also attended expert witness depositions in order to keep decorum. Plaintiff tenant sued defendant landlord and property management company for constructive eviction due primarily to habitability issues that plaintiff alleged were intentionally done by the new property owner in order to get tenant to move out of rent-controlled apartment. Plaintiff alleged claims for negligence, breach of the implied warranty of habitability, breach of quiet enjoyment, intentional infliction of emotional distress, breach of contract, breach of the covenant of good faith and fair dealing, private nuisance, and violation of local ordinance.
